A person convicted of a sixth DWI Offense is considered a “Habitual Offender”. Meaning the person has been found guilty of five or more intoxication-related traffic offenses committed on separate occasions; which is classified as a Class B felony. The penalties for a sixth offense are as follows:
Jail Time: For a class B felony, a term of years not less than five years and not to exceed fifteen years; A habitual offender shall not be eligible for parole or probation until he or she has served a minimum of two years imprisonment.
